This Class Action Settlement Agreement and Release (the “Agreement”) is entered into as of August 13, 2018 by and between Vincente Salcedo, Gerald Linden, and Brian Mervin (collectively, “Plaintiffs” or “Representative Plaintiffs”), individually and as representatives of the Class (as defined below), and Subaru of America, Inc. (“SOA”) and Subaru Corporation (“SBR”) (collectively, with SOA, “Defendants” or “Subaru”). Collectively, Plaintiffs and Defendants shall be referred to as the “Parties.” This Agreement is intended to fully, finally, and forever resolve, discharge, and settle the consolidated lawsuits captioned Salcedo v.
