This Settlement Agreement and Release (“Settlement Agreement”) is entered into by and between (i) Kevin Gruscinski and Gregory Coffey (“Plaintiffs” or “Settlement Class Representatives”), individually and on behalf of the Settlement Class (defined below); and (ii) Wasserstrom Holdings, Inc. (“Defendant” or “Wasserstrom”) in the case titled In re Wasserstrom Holdings, Inc. Data Breach Litigation, Case No. 2:23-cv-2070-MHW-EPD, United States District Court for the Southern District of Ohio, Eastern Division. Wasserstrom and Plaintiffs are collectively referred to herein as the “Parties.” The lawsuit being resolved is referred to herein as the “Litigation.”
