Subject to the approval of the Court, this Settlement Agreement (Settlement Agreement or Agreement) is made and entered into as of the Execution Date (as hereinafter defined), by and between Butterball (as hereinafter defined) and Class Plaintiffs (as hereinafter defined), individually and on behalf of a Settlement Class (as hereinafter defined), through Interim Co-Lead Counsel (as hereinafter defined) for the proposed Settlement Class, and in the above-captioned action (the Action).
