Customer hereby orders updates (“Updates”) to the software (“Software”) purchased by Customer pursuant to the Software License Agreement between Customer and Exan Enterprises Inc. and free telephone, facsimile and e-mail services (collectively “remote support”) indicated in the attached Exhibit “A”. Exan Enterprises Inc. ("EXAN") will provide the Updates and free remote support so indicated. Should Customer be liable for any state or local sales or excise taxes pursuant to this contract then Customer is responsible for remitting such sales or excise taxes directly to the taxing jurisdiction. EXAN will not be held responsible for any taxes not remitted.
