Background: Defendant, a member of the Northern Arapaho Tribe of Wyoming, was charged with violating Bald and Golden Eagle Protection Act after he shot bald eagle, without permit, for use in Sun Dance. Defendant responded that prosecu- tion was precluded by Religious Freedom Restoration Act (RFRA). The United
