This Settlement Agreement and Release (“Settlement Agreement” or “Settlement”) is entered into by and between: (i) Coastal Orthopedics & Sports Medicine of Southwest Florida, P.A. (“COSM” or “Defendant”), and (ii) Karl Ford, Barbara Balbo, and Vikki Comarsh-White (“Plaintiffs”) individually and on behalf of the Settlement Class (as defined below), in the consolidated class action In Re: Coastal Orthopedics & Sports Medicine of Southwest Florida Data Breach Litigation, Case No. 2024-CA-001078AX, in the Circuit Court of the Twelfth Judicial Circuit in and for Manatee County, Florida. COSM and Plaintiffs are collectively referred to herein as the “Parties.” The lawsuits, collectively, are referred to herein as the “Litigation.”
