(“Agreement”) is made and entered into as of this (the “Effective Date”) by and between the City of Frederick, Maryland, with an address of 101 North Court Street, Frederick, MD 21701 (“Buyer”) and Swanton MD ANEM #2 Solar, LLC, with an address of 111 Speen Street, Suite 410, Framingham, MA 01701 (“Developer”). Buyer and Developer are sometimes hereinafter referred to individually as a “Party” and collectively as the “Parties”.
