This Settlement Agreement is made and entered into this 7th day of October, 2014, by and between Defendant Barclays Bank plc (“Barclays”) and named Exchange-Based Class Plaintiffs Metzler Investment GmbH, FTC Futures Fund SICAV, FTC Futures Fund PCC Ltd., Atlantic Trading USA, LLC, 303030 Trading LLC, Gary Francis, and Nathanial Haynes (collectively the “Exchange-Based Plaintiffs”), for themselves and on behalf of each Class Member1 in FTC Capital GmbH, et al. v. Credit Suisse Group AG, et al., No. 11-cv-2613. This Agreement is intended by the Settling Parties to fully, finally and forever resolve, discharge and settle the Released Claims, upon and subject to the terms and conditions hereof.
