Action Item 2. Commitments to Address Discrimination, Including Harassment
Action Item 2. The District will develop a plan to track, in writing, implementation of the Student’s IEP, including the provision related to signing of the Student’s homework log, as well as implementation of the Student’s behavior intervention plan.1 The plan will note, by date, modifications to the general curriculum and whether each aid was used. If not used, the plan will describe why the aid was unnecessary. The plan also will include the date an aid initially was procured.

  • Within 10 days of the training in Action Item 2, the District will provide documentation to OCR demonstrating that it provided the training in accordance with Action Item 2.

  • By September 13, 2019, the EBRPSB will provide documentation to OCR evidencing that the training required by Action Item 2 has been completed, including the identity of the individual conducting the training and the individual’s qualifications, along with a copy of the materials or a summary of the material covered in such training and sign-in sheets or other documentation showing who attended the training.

Action Item 2. Opportunity to Reconvene CSE for Summer 2021 and 2022 ESY Students
Action Item 2. With respect to parents/guardians who elect to have the District convene a group of knowledgeable persons before the next regularly scheduled CSE meeting in order to determine whether compensatory services are necessary for the student, by January 31, 2014, the District will convene a group of knowledgeable persons (such as the CSE), including parents/guardians, to determine whether the student requires any compensatory services because the student was unable to attend school on May 24, 2013, as a result of the District’s failure to provide transportation services. If the group of knowledgeable persons determines that a student requires compensatory services, the group will develop a plan for providing those services; with a completion date for providing the services not to extend beyond June 30, 2014.

Action Item 2. During the duration of this Agreement, the District will provide OCR with an updated copy of the Student’s Section 504 Plan, if it is revised during the 2021 fall semester. REPORTING REQUIREMENT 2: The District will provide OCR a copy of the Student’s Section 504 Plan, if it is revised during the 2021 fall semester, within 10 business days of any revision.
Action Item 2. By March 5, 2018,the District will provide in-service training to all District staff (teachers, counselors, administrators) on: (1) the Notice rights of parents regarding the identification, evaluation, and educational placement of students with a disability; and (2) the District’s obligation under Section 504 and Title II to refrain from retaliation, pursuant to which the District may not harass, coerce, intimidate, or discriminate against any individual for the purpose of interfering with any right or privilege secured by the civil rights laws enforced by OCR or because any person has made a complaint, testified, or participated in any manner in an OCR investigation or proceeding.
Action Item 2. The Student is no longer enrolled in the District, however, if the Student reenrolls in the District, the District will apply the placement procedures created pursuant to Action Item 1 to the Student. Additionally, the District will include a copy of this Agreement in the Student’s permanent District record.
