Joint User shall reimburse Owner and any other Attaching Entity for reasonable and documented costs incurred for facilitating Joint User’s Attachments or for which Joint User is otherwise responsible for under this Agreement.
Such field verification shall be made jointly by both Parties and the actual and documented cost(s) shall be shared proportionately by Joint User and Owner, unless the Parties are also performing an inventory of any other Attaching Entity with Attachments on such Poles, and then the actual and documented costs shall be shared proportionately among all such Attaching Entities based upon the number of Attachments.
Joint User shall not allow its Facilities to impair the ability of Owner or any authorized third-party Attaching Entity to use Owner’s Poles, nor shall Joint User allow its Facilities to interfere with the operation of any of Owner’s Facilities or authorized third-party Attaching Entity’s Facilities.
As noted on the approved Permit, Joint User will notify any other Attaching Entity of such transfer or rearrangement.
If the Attachment that is non-compliant belongs to another Attaching Entity, then Brightspeed shall coordinate with City and the other Attaching Entity concerning any necessary rearrangement of Brightspeed’s Service Drop in conjunction with the Correction of the non-compliant Attachment.
