If Licensor has not diagnosed and corrected a Class 1 or Class 2 Error on the same day as Licensee's initial telephone call, Licensee shall submit to Licensor a listing of output and such other data as Licensor may request and is reasonably available to Licensee in order to reproduce operating conditions similar to those present when Licensee detected such Error.
For any Class 1 Error or Class 2 Error, Intersections shall provide DMS sufficient documentation to enable DMS to reproduce the Error and DMS shall then take all reasonably necessary steps to supply a correction to Intersections as soon as practicable.
An Error is a Class 2 Error if the Software is still usable for its intended purpose, but such use is seriously inconvenient and the value to Bank of America of the use of the Software is substantially reduced.

Without limitation of Supplier’s obligations above, Bank of America may fall back, at its option, to any previous version or release of the Software in which a Class 1 or Class 2 Error does not occur or can be worked around, and Supplier shall provide Maintenance Services at no charge, with respect to that version until Supplier provides a Correction.
If DMS is unable to reproduce a Class 1 Error or Class 2 Error, the parties will work in good faith to correct such Error on a mutually agreed-upon schedule.
If DMS provides Intersections with a workaround for a Class 1 Error, such Error will be re-classified as a Class 2 Error.
If CaseWorthy provides Customer with a work-around acceptable to Customer for a Class 1 Error, such Error will be re-classified as a Class 2 Error.
If Supplier fails to provide a Correction within 30 days after Bank first reported the Class 1 or Class 2 Error, Bank may terminate this Agreement for Supplier's material breach.
