CMS Contract definition

CMS Contract means the contract between Payer and CMS under the Medicare Advantage Program.
CMS Contract means the contract between Aetna and CMS under which Aetna offers the Plan(s) in the applicable time period.
CMS Contract means the contract between CMS and HealthSun for purposes of HealthSun’s participation in the Medicare Advantage and Medicare Part D Programs.

  • Provider acknowledges and agrees that MA Organization receives federal payments under the CMS Contract and that payments Provider receives from or on behalf of MA Organization are, in whole or in part, from federal funds.

  • Provider also shall perform the services set forth in the Agreement in a manner consistent with and in compliance with Health Plan’s contractual obligations under the CMS Contract.

  • Agent or Agency acknowledges and agrees that Medica oversees and is ultimately accountable to CMS for any functions and responsibilities described in the applicable CMS Contract and applicable regulations or CMS sub-regulatory guidance, including those that Medica may delegate to Agent or Agency.

  • Provider shall grant MA Organization or its designees such audit, evaluation, collection and inspection rights identified in subsection 3.9(c) as are necessary for MA Organization to comply with its obligations under the CMS Contract.

  • Provider shall perform the services set forth in the Agreement in a manner consistent and compliant with MA Organization’s contractual obligations under the CMS Contract.

  • Provider acknowledges and agrees that the U.S. Department of Health and Human Services, the Comptroller General, or their designees shall have the right (directly or through the MA Organization) to audit, evaluate, collect, and inspect any pertinent books, contracts, computer or other electronic systems (including medical records and documentation), and other records and information of Provider related to the CMS Contract.

  • Any reference to HCSC herein shall mean the HCSC Affiliate in those instances where an HCSC Affiliate holds the CMS Contract.

CMS Contract means the contract entered into by CMS and the Company pursuant to which the Company offers one or more MA Plans in a specified service area or region.

  • Service Contract means, with respect to a Financed Vehicle, the agreement, if any, financed under the related Receivable that provides for the repair of such Financed Vehicle.
