Upon termination of such occupancy, CLEC at its expense shall remove its equipment and other property from the Collocation space.
The terms and conditions under which Collocation will be available are described in Article IX of this Agreement.
CLEC shall have thirty (30) Days from the termination date to complete such removal, including the removal of all equipment and facilities of CLEC's Guests; provided, however, that CLEC shall continue payment of monthly fees to Brightspeed until such date as CLEC has fully vacated the Collocation space.
Collocation shall be provided on a nondiscriminatory basis, on a “first-come, first- served” basis, and otherwise in accordance with the requirements of the Act (including 47 U.S.C. §251(c)(6)).
CLEC will surrender the Collocation space to Brightspeed in the same condition as when first occupied by CLEC, except for ordinary wear and tear.
