Contract Maximum Amount definition

Contract Maximum Amount means 212.34 MWh per hour of Energy and a corresponding portion of all other Products, as may be adjusted in accordance with Sections 3.3(b) and 3.3(c).

  • To the extent that Seller has constructed the Facility in accordance with Good Utility Practice, and met all other requirements under Section 3.4(b) of this Agreement, if the Independent Engineer’s certification provides that the Actual Facility Size exceeds the Proposed Facility Size as provided in Exhibit A, the Buyer’s Percentage Entitlement will be recalculated and replaced by the percentage derived by dividing the Contract Maximum Amount by the Actual Facility Size.

  • If the Commercial Operation Date is not achieved by the date set forth therefor in Section 3.1(a) (as extended pursuant to Section 3.1(c)), Seller shall pay to Buyer damages for each month from and after such date until the Commercial Operation Date at the rate of $1.50 per kwh of Contract Maximum Amount up to a maximum of twelve (12) months of delay, pro rated for partial months (“Delay Damages”).


More Definitions of Contract Maximum Amount

Contract Maximum Amount means 2.217 MWAC and a corresponding portion of all other Products, as may be adjusted in accordance with Section 3.3(b).
