For clarity, PSS’s Confidential Information includes PSS Background IP Rights, PSS Specifications, Developed IP Rights and Created Data.
All Equipment, Created Data and performance produced as part of the activities that are the subject matter of the Contract shall be owned exclusively by PSS.
Neither Supplier, its Affiliates or its subcontractors or any other party who has copyright to any works comprising any such Equipment, Created Data or performance, shall object to modification and/or translation of the Equipment, Created Data or performance by PSS.
The Provider must, in retaining the Agency Data and Created Data, comply with its obligations under this Head Agreement and any Contract.
PSS shall have all right, title and interest, including but not limited to all right to obtain copyright, patents or other protections, in and to such Equipment, Created Data and performance, and any works used as a basis for creating such Equipment, Created Data or performance.
The Solutions Provider acknowledges that any Created Data shall be deemed to be a separate copy of the Data.
