For a period of ten (10) years from the applicable Date of Provisional Acceptance or Date of Commercial Acceptance of the System whichever is earlier, the Contractor will make available to the Purchaser replacement parts and repair service for the System as may be reasonably necessary for its operation, maintenance or repair.
If the Purchaser (or the Independent Engineer on its behalf) fails to respond with such notification within thirty (30) days, then the Date of Provisional Acceptance of the Segment (subject to Purchaser's consent), the System or System Upgrade shall be deemed to be the date such Commissioning Report or Upgrade Commissioning Report, as the case may be, was received by the Purchaser.

The Contractor agrees that, except with respect to Segment 6, the Date of Provisional Acceptance of the System or Date of Commercial Acceptance of the System will occur by December 30, 2000 (as such date may be extended under Article 6 (Contract Variations), Article 17 (Force Majeure) or otherwise under this Contract or by written agreement of the Parties (the "Scheduled --------- RFS Date")).
