The Buyer shall cause any BFE supplier approved under this Clause 18.1.1.2 (each an “Approved BFE Supplier”) to comply with the conditions set forth in this Clause 18 and specifically Clause 18.2. The Seller shall advise the Buyer reasonably in advance of the dates by which, in the planned release of engineering for the Aircraft, the Seller requires a written detailed engineering definition encompassing a Declaration of Design and Performance (the “BFE Engineering Definition”).
It will be the Buyer’s sole responsibility to ensure that all studies and engineering developments will have been performed in due time, in anticipation of providing the corresponding BFE Engineering Definition for such BFE Premium Class Seats and the related BFE in-flight entertainment in-seat components, including the associated Declaration of Design and Performance.
The DCA issues a Letter of Declaration of Design and Performance (DDP) Approval for appliances of a kind for which a performance standard has been published in an FAA Technical Standard Order (TSO).
If an FAA TSO Authorization or Letter of Design Approval holder, or a DCA Declaration of Design and Performance holder elects to surrender the TSO or DDP approval issued by the FAA or DCA respectively, as exporting authorities, the FAA or DCA will immediately notify the other in writing of the action.
Major changes to a TSO design require resubstantiation of the new design and reissuance of the Letter of Declaration of Design and Performance (DDP) Approval.
