Effective September 23, 2013, if VOV requests an electronic copy of PHI that is maintained electronically in a Designated Record Set in MSEB ’s custody or control, MSEB will provide an electronic copy in the form and format specified by VOV if it is readily producible in such format; if it is not readily producible, MSEB will work with VOV to determine an alternative form and format that enable VOV to meet its electronic access obligations under 45 C.F.R. § 164.524.
The Business Associate will make any amendment(s) to Protected Health Information in a Designated Record Set as directed or agreed to by the Covered Entity or take other measures as necessary to satisfy Covered Entity’s obligations under the HIPAA Regulations related to amendment of Protected Health Information.
Upon written notice by Covered Entity, Business Associate agrees to make PHI, if maintained by Business Associate in a Designated Record Set, available within ten (10) business days to Covered Entity for subsequent amendment by the Individual subject thereof and incorporate any amendments to PHI in accordance with applicable law (including, but not limited to, the HIPAA Regulations, 45 C.F.R. § 164.526).
The Receiving Party shall promptly forward to the Disclosing Party any request to access or amend PHI in a Designated Record Set that the Receiving Party receives directly from an Individual (or an Individual’s authorized representative).
Business Associate shall promptly take all actions necessary for Covered Entity to comply with 45 C.F.R. §§164.524 and 164.526, including but not limited to providing Covered Entity timely access to PHI in a Designated Record Set and making any amendment(s) to PHI in a Designated Record Set as requested and directed by Covered Entity.
