Differing Site Condition definition
Differing Site Condition is any physical condition at the Project Site that is materially different from those implied in the Plans and Specifications or those normally encountered in the construction of this type of Project. Differing Site Conditions may include, without limitation, abnormal soil conditions, undocumented or incorrectly documented sewer or water laterals, the need to remove and transport excess fill, the need for water pumping, etc. If Builder encounters a Differing Site Condition, Builder shall provide notice to Owner as soon as reasonably possible. Builder will not disturb the Differing Site Condition prior to notification and direction from Owner except as necessary to protect the safety of individual, the Project Site and the Work. Any changes to the Contract Price and the Substantial Completion Date as a result of the Differing Site Condition should be done by a written Change Order. If a Differing Site Condition is encountered by Builder when performing the Work, then the Contract Price and the Substantial Completion Date shall be adjusted as follows: (i) the Contract Price shall be adjusted to include the additional costs incurred by Builder plus an additional amount of zero percent (0%) of the additional costs; and (ii) the Substantial Completion Date shall be extended a reasonable number of days necessary to complete the Work as a result of the Differing Site Condition.
Differing Site Condition means the “differing site condition” determination as set forth in GCDB Section 3.6.
Differing Site Condition means subsurface or latent physical conditions that are encountered at the Site and differ materially from the conditions indicated in the Contract. It may also be unknown physical conditions of an unusual nature, differing materially from those ordinarily encountered and generally recognized as inherent in the type of Work provided for in the Contract, provided in all cases that the Design-Builder had no actual or constructive knowledge of such conditions as of the Proposal Date.

City and Troon will promptly investigate the conditions, and if the City finds that the conditions do constitute a Differing Site Condition that causes a decrease or increase in the Contractor’s cost of, or time required for, performance of any part of the Renovation Project, the City may issue a change order under the procedures described in this Funding Agreement.
More Definitions of Differing Site Condition
Differing Site Condition means concealed or latent physical conditions at the Site that: (i) materially differ from the conditions indicated in the Contract Documents; and (ii) are of an unusual nature, differing materially from the conditions ordinarily encountered and generally recognized as inherent in the Work.
Differing Site Condition means the “differing site condition” determination as set forth in Section 3.5 of the General Conditions.
Differing Site Condition means those unforeseen conditions described in Paragraph 4.4.9, below, that constitute a ground for Contract Adjustment.

If a Differing Site Condition requires a material change in the Work, the Design-Builder shall be eligible for time and cost relief on account of such condition in accordance with GP 3.04, GP 3.06A and GP 5.01E and as further provided in this GP 2.15.
