Error Condition definition

Error Condition means any demonstrable, reproducible defect, program error, or other non-conformance of the Software with its Documentation caused solely by errors or defects in the code of the Software.
Error Condition means the services are 1 not responding to end user requests, 2 incorrectly sending end users error condition messages or 3 sending incorrect partial content to end users and these conditions are observable or reproducible by you or Fastly.
Error Condition means a defect in or failure of the Licensed Program to conform in any non-immaterial respect to the Specifications. In addition, SELLER shall adhere to the following procedure when UTILITIES encounters a problem which diagnosis indicates is caused by a defect in a current unaltered release of the Licensed Program: SELLER shall make a reasonable attempt to develop an emergency by-pass within two (2) business days after notification by UTILITIES, and issue corrected code within one (1) calendar month after notification by UTILITIES. If SELLER does not promptly comply with the foregoing, or in an emergency where delay would cause serious risk of loss or damage, UTILITIES may have services performed by a third party, and all costs, losses, and damages arising out of or relating to such services will be paid by SELLER.

  • Notwithstanding the foregoing, if a Systemic Error Condition occurs and Marketer has not corrected that condition within twice the allocated response time set forth above and CBKC wishes to cause an escrow release, CBKC shall provide written notice of the same simultaneously to the Technology Escrow Agent and Marketer, and the Technology Escrow Agent may release the Technology Deposit Materials for the impacted Marketer Technology immediately to CBKC to address the Systemic Error Condition.

  • If Ambient is unable to correct such non-conforming Software or replace it with conforming Software within the time periods and as otherwise required by this Section 4.2, and such non-conformity has resulted in a Systemic Error Condition, Ambient’s failure to so correct such non-conformity shall be deemed a material breach of this Agreement by Ambient.
