FIFO Processing Queue definition

FIFO Processing Queue means the FIFO line-up on which the Trust reviews Complete Claim Submissions.
FIFO Processing Queue means the FIFO line-up on which the Settlement Trust reviews Trust Claims Submissions.
FIFO Processing Queue shall have the meaning set forth in Section 5.1(b)(i)(1).

Examples of FIFO Processing Queue in a sentence

  • If any claims are filed and diagnosed on the same date, the claimants' position in the FIFO Processing Queue shall be further determined by the claimants' date of birth, with older claimants given priority over younger claimants.

  • A claimant can also request that the processing of his or her Plan Trust PI Asbestos Claim by the Plan Trust be deferred for a period not to exceed three (3) years without affecting the status of the claim for statute of limitation purposes, in which case the claimant shall also retain his or her original place in the FIFO Processing Queue.

  • If a claimant fails to respond to the Plan Trust's notice prior to the Plan Trust reaching such claimant's TDP Valued Asbestos Claim in the FIFO Processing Queue, the Plan Trust will process and liquidate such TDP Valued Asbestos Claim under the Expedited Review Process based on the medical and or exposure evidence submitted by such claimant with his or her proof of claim form, provided that such claimant shall retain the right to request review in the Individual Review Process.

  • Notwithstanding the FIFO Processing Queue, the Plan Trustees shall have the right to establish appropriate procedures to evaluate TDP Valued Asbestos Claims which constitute Extraordinary TDP Valued Asbestos Claims or Exigent Hardship Claims.

  • Eligibility of a claim transmitted electronically to VERUS for the FIFO Processing Queue as defined in the TDP shall be determined under the Procedures.

  • If a Tort Claimant fails to provide such additional claim information pursuant to the Claims Reviewers' notice prior to the Claims Reviewers considering the Tort Claimant’s Tort Claim in the FIFO Processing Queue, the Claims Reviewers will process, consider and liquidate the Tort Claim under the Expedited Review Process based solely on the information submitted by such Tort Claimant in the proof of claim form, along with any evidence submitted by the Reorganized Debtor pursuant to 3.1(b)(i)(4) below.

  • As a proof of claim form is reached in the FIFO Processing Queue, the Asbestos Trust shall determine whether the claim described therein meets the Medical/Exposure Criteria for one of the Disease Levels, and shall advise the claimant of its determination.

  • If any claims are filed on the same date, the claimant’s position in the FIFO Processing Queue shall be determined by the date of the diagnosis of the asbestos- related disease.
