Final Judgment Date definition

Final Judgment Date means (i) the date of the judgment in the case of a judgment from which no right or leave to appeal lies, (ii) the date on which a court of competent jurisdiction denies leave to appeal a judgment, unless that denial may itself be appealed, or (iii) the date of the expiry of the applicable appeal period in the case of a judgment, or of an appealable denial of a leave to appeal, from which no appeal or application to seek leave to appeal is made, as applicable;
Final Judgment Date means the later of the following dates upon which the Judgment shall become final (the “Final Judgment”): (1) the expiration of the period for filing a notice of appeal of the Judgment; or (2) if a notice of appeal is filed, the date the appeal is dismissed or denied and the Judgment is no longer subject to appeal or other appellate review. Notwithstanding the foregoing, any proceeding or order, or any appeal or petition for a writ pertaining solely to the award of attorneys’ fees or litigation costs pursuant to Section 2.11.1 shall not, by itself, in any way delay or preclude the Judgment from becoming a Final Judgment, provided the total attorneys’ fees and litigation costs at issue do not exceed $300,000.
Final Judgment Date means the later of the following dates upon which the Judgment shall become final (the “Final Judgment”): (1) the date the period for filing a notice of appeal of the Judgment expires; or (2) if a notice of appeal is filed, the date the appeal is dismissed or denied and the Judgment is no longer subject to appeal or other appellate review. Notwithstanding the foregoing, any proceeding or order, or any appeal or petition for a writ pertaining solely to the award of attorneys’ fees or litigation costs pursuant to Section 2.10.1 shall not, by itself, in any way delay or preclude the Judgment from becoming a Final Judgment, provided the total attorneys’ fees and litigation costs at issue do not exceed 25% of the Maximum Settlement Amount and $30,000, respectively.’’

Examples of Final Judgment Date in a sentence

  • The rights and obligations of the Parties in this Settlement Agreement and each Related Agreement shall survive the Effective Final Judgment Date and the Closing Date.

  • Any fees and expenses awarded to Settlement Class Counsel shall be paid within ten (10) days after the Effective Final Judgment Date, or in the event the Court has not yet awarded attorneys’ fees as of the Effective Final Judgment Date, within ten (10) days of the date such attorneys’ fee award is made and the time to appeal such award expires.

  • CorVel shall have no obligation to make any Settlement Payments until at least 90 days after the Effective Final Judgment Date and shall have a total of 180 days from the Effective Final Judgment Date to complete the initial Settlement Payments to members of the Settlement Class.

  • Once the Preliminary Approval Order is entered and before the Effective Final Judgment Date, and subject to the limits set forth in paragraph 9, CorVel shall pay reasonable notice costs and any administrative costs that must be incurred prior to the Effective Final Judgment Date.

  • The Final Judgment and Order shall be deemed final on the Effective Final Judgment Date.

  • All Rent Increases shall be calculated at the amount assigned to the Units based on Defendant’s documentation produced during discovery and as updated through the Order and Final Judgment Date.

Related to Final Judgment Date

  • Final Judgment means the Judgment Entered by the Court upon Granting Final Approval of the Settlement.

  • Order and Final Judgment means the order and final judgment of the Court approving the Settlement Agreement, as described in Section II(E)(7) below.

  • Alternate Judgment means a form of final judgment that may be entered by the Court herein but in a form other than the form of Judgment provided for in this Stipulation.

  • Professional Judgement shall be defined as judgement that is informed by professional knowledge of curriculum expectations, context, evidence of learning, methods of instruction and assessment, and the criteria and standards that indicate success in student learning. In professional practice, judgement involves a purposeful and systematic thinking process that evolves in terms of accuracy and insight with ongoing reflection and self-correction.

  • Alternative Judgment means a form of final judgment that may be entered by the Court but in a form other than the form of Judgment provided for in this Stipulation and where none of the Parties hereto elects to terminate this Settlement by reason of such variance.
