For purposes of calculating the Availability Adjustment, the Facility shall be considered Available during any time that the Facility would have been actually Available but for conditions (including, for example, transmission outages or interruptions) on the Interconnected Utility System.
For purposes of calculating the Availability Adjustment, the Facility shall be considered Available during any such increase, reduction, curtailment, interruption or action, unless the order to increase, reduce, curtail, interrupt, or take other action with respect to generation at the Facility or the Emergency Condition is caused by a condition on Seller's side of the interconnection point between the Facility and the Interconnected Utility System.

In the event that electricity delivered by Seller hereunder fails to conform to the specifications of the Interconnected Utility, Seller shall (as soon as reasonably practicable after becoming aware thereof) notify Buyer of the same and of its best good faith estimate of the duration and extent of such failure to conform, and Seller shall attempt to cure such failure as soon as reasonably practicable thereafter.
Seller shall pay all costs associated with interconnecting the Facility to the Interconnected Utility System, including any facilities upgrades required by ComEd.
Buyer acknowledges that other conditions on the Interconnected Utility System (for example, transmission outages or interruptions) may impact Seller's ability to deliver Electric Energy into the Interconnected Utility System at the Point of Delivery.
