If the County does not issue a Notice of Availability for a Licensed Fiber, Interconnection Fiber, or Interconnection Point by that date, the Licensee may, by written notice to the County, terminate this Agreement as to such Licensed Fiber, Interconnection Fiber or Interconnection Point.
Pending a Commission decision in WUTC Docket No. UT-063038, however, the Parties agree that all traffic between a calling party and an ISP where both have been assigned telephone numbers rated as local to the ▇▇▇▇▇▇ Local Calling Area will be considered Information Access Traffic for purposes of this agreement if that traffic is exchanged via an Interconnection Point within the ▇▇▇▇▇▇ Local Calling Area, which is the only area in which the Parties contemplate exchanging traffic under this Agreement.
The County is not liable to the Licensee for damage to the County Network, the Licensed Fibers, the Interconnection Fibers, any Interconnection Point, or the Licensee’s Equipment that is caused by third parties.
The terms of this Agreement apply only to (i) the Licensed Fibers; (ii) the Interconnection Fibers, up to the points of demarcation between the Interconnection Fibers and the Licensee’s Equipment at each Interconnection Point; and (iii) Interconnection Points located within any County Facilities.
A Notice of Availability for an Additional Interconnection Point shall include an estimate of the Interconnection Costs, if any.
