Landscape Buffer definition

Landscape Buffer means that part of the Land within the Landscape Buffer or Landscape Buffer Zone identified on the Development Plan.

  • Notwithstanding anything contained herein to the contrary, the Tenant of any Building Site retains legal title to the leasehold estate encumbered by the Landscape Buffer.

  • Except in the case of an emergency, if the Owners cannot reach a mutual agreement as to their obligations for maintenance, repairs, replacement or reconstruction, or for damage or destruction, to the Landscape Buffer, Privacy Wall and/or Pool Fence, then the Owners mutually agree to first submit the dispute to mediation within fifteen (15) days of the initial written notification of the dispute.

  • Declarant and all subsequent Owners shall have a perpetual reciprocal easement for the Landscape Buffer, Privacy Wall and Pool Fence and for reasonable access, upon prior reasonable written notice, in that part of the Property of the other Owner on which the Landscape Buffer, Privacy Wall and Pool Fence are located, as may be reasonably necessary or desirable to carry out the purpose and intent of this Declaration.

  • The “Pool Fence” shall mean the pool fencing which is attached to, or otherwise an extension of, either end of the Privacy Wall to be constructed within the Landscape Buffer between the Lots.

  • Declarant and all subsequent Owners, including the Declarant’s or Owners’ licensed and insured contractors, licensees, and/or agents, shall have a perpetual reciprocal easement for reasonable access, upon prior reasonable written notice, in that part of the Property of the other Owner for the purpose of repairing, maintaining or restoring the Landscape Buffer, Privacy Wall and Pool Fence.

Landscape Buffer means all subdivision walls, fences, gates and landscaping erected by the developer, his successor(s) in interest or the Association, (including the improvements thereto).
Landscape Buffer means those portions of the Property within three feet (3’) of either side of the common boundary between the Lots, being more particularly described on the Plat, which area shall be legally deemed a common landscape buffer in all respects for the reciprocal use and enjoyment of the Owners of the Lots, and shall be subject to the covenants, conditions, easements, and restrictions set forth in this Declaration.

  • Landscape means an area, as perceived by people, whose character is the result of the action and interaction of natural and/or human factors;

  • Landscape waste means any vegetable or plant wastes except garbage. The term includes trees, tree trimmings, branches, stumps, brush, weeds, leaves, grass, shrubbery and yard trimmings.

  • Landscaping means the treatment of land (other than buildings) being the site or part of the site in respect of which this planning permission is granted, for the purpose of enhancing or protecting the amenities of the site and the area in which it is situated and includes screening by fences, walls or other means of enclosure; measures to screen the refuse provision; planting of trees, hedges, shrubs or grass; formation of banks, terraces or other earth works, laying out of gardens, paved areas or courts and other amenity features.

  • Landscaped area means all the planting areas, turf areas, and water features in a landscape design plan subject to the Maximum Applied Water Allowance and Estimated Applied Water Use calculations. The landscaped area does not include footprints of buildings or structures, sidewalks, driveways, parking lots, decks, patios, gravel or stone walks, other pervious or non-pervious hardscapes, and other non-irrigated areas designated for non-development (e.g., open spaces and existing native vegetation).

  • Landscape architect means a person who holds a license to practice landscape architecture in the state of California Business and Professions Code, Section 5615.
