Litigation Class definition

Litigation Class is defined in the WHEREAS clauses of this Agreement.
Litigation Class means the class of Missouri borrowers defined by the Court in the Litigation in the Order Certifying Plaintiffs’ Class, entered January 2, 2003.
Litigation Class means the litigation class, certified by the Circuit Court of Clay County Missouri on January 2, 2003, comprised of those persons who obtained a Missouri second mortgage loan from PCC on or after June 27, 1994 and who paid or financed the payment of certain fees at or before the closing.

  • If a court of competent jurisdiction determines that all or part of this Litigation Class Action Waiver is unenforceable, unconscionable, void or voidable, the remainder of this Agreement shall remain in full force and effect.

  • To validly request exclusion from the Settlement Class, a member of the Settlement Class must submit a written request to opt out to the Settlement Administrator so that it is postmarked by the Objection and Opt-Out Deadline stating that “I wish to exclude myself from the Settlement Class in the NIBCO Litigation Class Action Settlement” (or substantially similar clear and unambiguous language).

  • In addition to taking into account the uncertain outcome and risk of the Litigation, Class Counsel have considered the difficulties and delay inherent in such litigation.

  • Deutsche Bank will not oppose certification of a Settlement Class, but reserves the right to contest certification of a Litigation Class, to defend all claims in the Action, and to assert any claims, rights and defenses in the Action if the Settlement Class is not certified or if this Settlement Agreement does not receive Final Approval.

  • The Custodian/Escrow Agent shall establish and maintain one or more Custodian/Escrow accounts titled as Novartis and Par Antitrust Litigation Class Settlement (the “Custodian/Escrow Account”).

  • In connection with the underlying Litigation, Class Counsel reviewed and analyzed thousands of pages of documents and discovery responses produced in this Litigation.

  • Given the termination of ▇▇▇▇▇▇▇▇▇’▇ bankruptcy proceeding and the bankruptcy trustee’s abandonment of the Litigation, Class Counsel agrees that, as part of or in connection with seeking the Preliminary Approval Order (as described below in Paragraph 8), ▇▇▇▇▇▇▇ (or ▇▇▇▇▇▇▇▇▇’▇ bankruptcy trustee) will be replaced with ▇▇▇▇▇▇▇ ▇▇▇▇▇ as a substitute class representative and to act on behalf of and for the benefit of ▇▇▇▇▇▇▇▇▇’▇ heirs.

  • Within ten (10) business days of the Effective Date, Lead Plaintiffs, Lead Plaintiffs' Counsel or counsel for the ▇▇▇▇▇▇▇▇ plaintiff shall take steps to dismiss with prejudice the In re ▇▇▇▇▇▇ ▇▇▇▇▇ Holder Litigation Class Action, now pending in the United States Court of Appeals for the Ninth Circuit.

  • Members of the California Litigation Class who did not file an objection by the Objection Deadline or a claim by the Claim Filing Deadline shall have no further right to exclude themselves from the California Litigation Class, even if the Settlement is not approved or the Effective Date does not occur.

  • The Long Form Notice shall advise members of the California Litigation Class that, if the settlement is not finally approved, or if the Effective Date does not occur for any other reason, then the ▇▇▇▇▇▇ Action will continue on behalf of the California Litigation Class.

Related to Litigation Class

  • Litigation Claims means the claims, rights of action, suits or proceedings, whether in law or in equity, whether known or unknown, that any Debtor or any Estate may hold against any Person or Entity, including, without limitation, the Causes of Action of the Debtors or their Estates, in each case solely to the extent of the Debtors’ or their Estates’ interest therein. A non-exclusive list of the Litigation Claims held by the Debtors as of the Effective Date will be Filed with the Plan Supplement, which will be deemed to include any derivative actions filed against any Debtor as of the Effective Date.

  • Companion Class With respect to each Lower Tier Regular Class, any Class of Trust Fund Certificates appearing opposite such Lower Tier Regular Class in the Lower Tier Schedule.

  • Released Class Claims means the claims being released as described in Paragraph 5.2 below.

  • Unimpaired Class means an unimpaired Class within the meaning of section 1124 of the Bankruptcy Code.

  • Unresolved Claims has the meaning set forth in Section 7.6(c).
