Implementation: the implementation of a Relevant Planning Permission by the carrying out of a Material Operation provided that, for the purposes of this deed, implementation of a Relevant Planning Permission shall be deemed to have occurred notwithstanding any breach of a condition to that Relevant Planning Permission.
Material Operation: has the same meaning as in section 56 of the TCPA 1990 but disregarding for the purposes of this deed and for no other purpose, the following operations: ground investigations; site survey works; temporary access construction works; archaeological investigation; and erection of any fences and hoardings.
The Owner shall prior to carrying out any Material Operation on the Planning Application Site serve the Notice of Intention to Commence Development giving at least 7 days’ notice of the intended start date for the Commencement of Development.
The Owner shall pay 20 per cent of the Affordable Housing Contribution to the Council prior to carrying out or permitting the carrying out of a Material Operation as part of the Development on any part of the Site; and the remaining 80 per cent of the Affordable Housing Contribution on or before occupation of 20 per cent of the dwellings to be constructed as part of the Development.
If the ▇▇▇▇▇ Road Planning Permission shall be quashed as a result of any legal proceedings, is revoked or otherwise withdrawn, or expires without any Material Operation occurring then the provisions of this Agreement relating to the ▇▇▇▇▇ Road Development shall absolutely determine and become null and void.
