Minimum Capacity Level definition

Minimum Capacity Level means (a) with respect to a Block, *** percent (***%) of the Guaranteed Capacity of such Block (as adjusted for uncertainty in accordance with Exhibit 16A) and (b) with respect to the Facility, the aggregate of the Capacity Test values for all Blocks equals at least *** percent (***%) of the Guaranteed Capacity of the Facility, in each case, as calculated in accordance with Exhibit 16A.
Minimum Capacity Level means ninety-seven percent (97%) of the Guaranteed Capacity of the Facility, calculated in accordance with Exhibit 14D.

Examples of Minimum Capacity Level in a sentence

  • If the Final Test Results reveal that the relevant Block has satisfied the Minimum Capacity Level but not the Guaranteed Capacity (as adjusted for uncertainty in accordance with Exhibit 16A), Contractor may elect to perform additional Work (if it deems necessary) and repeat the Capacity Test.

  • Contractor shall, as soon as practicable following the completion of a Capacity Test in which the Final Test Results reveal that the Minimum Capacity Level for such Block has been achieved, submit to Owner's Representative a Capacity Test Certificate, signed by Contractor's Representative and attaching the Final Test Results performed pursuant to Exhibit 16A.

  • Contractor shall conduct Functional Tests for each Block in accordance with Exhibit 27 and when Contractor believes that a Block can satisfy the Minimum Capacity Level, Contractor shall conduct the Capacity Test with respect to each Block in accordance with Exhibit 16A.

  • If the Final Test Results reveal that the relevant Block fails to meet the Minimum Capacity Level for such Block, Contractor shall repeat the respective Capacity Test as many times as necessary until the Minimum Capacity Level has been met.

  • Contractor shall take all corrective actions so that such Block successfully completes the Capacity Test and meets the Minimum Capacity Level, without prejudice to Owner's rights and remedies under this Agreement.

  • A Capacity Test Certificate signed by Owner is deemed conclusive evidence that such Block has met the Minimum Capacity Level required under this Agreement (“Acceptance”).

  • A Capacity Test Certificate signed by Owner is deemed conclusive evidence that the Facility has met the Minimum Capacity Level required under this Agreement.

  • Contractor shall conduct the Availability Test and Functional Test for the Facility in accordance with Exhibit 25, and when Contractor believes that the Facility can satisfy the Minimum Capacity Level, Contractor shall conduct the Power Plant Controller Test and the Capacity Test in accordance with Exhibit 14B or Exhibit 14C, as applicable.

  • Contractor shall take all corrective actions so that the Facility successfully completes the Capacity Test and meets the Minimum Capacity Level, without prejudice to Owner’s rights and remedies under this Agreement.

  • If the Final Test Results reveal that the Facility fails to meet the Minimum Capacity Level, Contractor shall repeat the Capacity Test as necessary until the Minimum Capacity Level has been met.

Related to Minimum Capacity Level

  • Maximum Capacity or ‘Pmax’ means the maximum continuous active power which a power-generating module can produce, less any demand associated solely with facilitating the operation of that power-generating module and not fed into the network as specified in the connection agreement or as agreed between the relevant system operator and the power-generating facility owner;

  • Nameplate Capacity Rating means the maximum capacity of the Facility as stated by the manufacturer, expressed in kW, which shall not exceed 10,000 kW.

  • Minimum Level (ML) means the concentration at which the entire analytical system must give a recognizable signal and an acceptable calibration point. The ML is the concentration in a sample that is equivalent to the concentration of the lowest calibration standard analyzed by a specific analytical procedure, assuming that all the method-specified sample weights, volumes and processing steps have been followed.

  • Available RP Capacity Amount means the amount of Restricted Payments that may be made at the time of determination pursuant to Sections 6.04(a)(i)(D), (a)(ii), (a)(vi), (a)(ix), (a)(xii), (a)(xviii) and (a)(xix) minus the aggregate amount of the Available RP Capacity Amount utilized by Parent or any Restricted Subsidiary to (a) make Investments pursuant to Section 6.06(q)(ii) or (b) make Restricted Debt Payments pursuant to Section 6.04(b)(iv)(B).

  • Storage Capacity means any combination of space, injectability and deliverability.
