Mobile communication device definition

Mobile communication device means a mobile phone or any wireless handheld device (such as a tablet computer) designed or capable of being used for a communicative function.
Mobile communication device means any portable electronic device capable of transmitting or receiving data in the form of a voice, text message, or capable of accessing the Internet (“Mobile Communication Device”). The Governing Board recognizes that the use of Mobile Communication Devices, including cell phones, smartphones, smart watches, earbuds, or other like devices, and District issued devices on campus may be beneficial to student learning and well-being, but can also be disruptive of the instructional program in some circumstances. The Board permits limited use of Mobile Communication Devices on campus in accordance with law and the following policy. When a student uses a Mobile Communication Device in an unauthorized manner, the student may be subject to behavior interventions, including up to formal discipline, and a district employee may confiscate the device. Unauthorized use includes but is not limited to the use of a camera, video, or voice recording to function in a way or under circumstances which infringe upon the privacy rights of others. (Education Code 51512) A school administrator may search a Mobile Communication Device in accordance with BP/AR 5145.12 - Search And Seizure, if they have a reasonable suspicion that a search of a student's Mobile Communication Device will turn up evidence of the student's violation of the law or school rules. A student may also be subject to discipline, in accordance with law, Board policy, and administrative regulation for on-campus or off-campus use of a Mobile Communication Device which poses a threat or danger to the safety of students, staff, or district property, constitutes threats, bullying, or harassment of students or staff in way that impacts the school environment, or substantially disrupts school activities or the school environment. (BP/AR 5131 - Conduct, BP/AR 5144.1 - Suspension And Expulsion/Due Process) The Superintendent or designee shall inform students that the district will not be responsible for a student's Mobile Communication Device which is brought on campus or to a school activity and is lost, stolen, or damaged.
