Net Settlement Value definition

Net Settlement Value means the portion of the Gross Settlement Value
Net Settlement Value means the Gross Settlement Value less the Fee and Expense
Net Settlement Value means, at any time, the market value of all Unencumbered Liquid Assets, less the usual and customary fees and commissions chargeable upon a sale or other liquidation thereof.

  • Your share of the Net Settlement Value will be based on the value of your past and projected future benefits (including benefits either paid to your Associated Class Member Participant, if you are the beneficiary, or which may be paid to your Associated Beneficiary, if you are the Participant), compared to the value of all Class Members’ past and projected future benefits.

  • A Participating Class Member who is a Group 2 Class Member will receive 30% of the Net Settlement Value times the total Qualified Days Worked that Class Member worked during the Settlement Period divided by the total Qualified Days Worked by all Group 2 Class Members during the Settlement Period.

  • A Participating Class Member who is a Group 1 Class Member will receive 6% of the Net Settlement Value times the total Qualified Days Worked that Class Member worked during the Settlement Period divided by the total Qualified Days Worked by all Group 1 Class Member during the Settlement Period.

  • A Participating Class Member who is a Group 3 Class Member will also receive 64% of the Net Settlement Value times the total Qualified Days Worked by that Class Member during the Settlement Period divided by the total Qualified Days Worked by all Group 3 Class Members during the Settlement Period.


More Definitions of Net Settlement Value

Net Settlement Value or “NSV” means the portion of the Gross Settlement Value available for distribution to Class Members after the deduction of (1) the Class Representative Enhancement Payments to Plaintiffs Joshua Mendoza, Randy Williams, and Omar Rivas in an amount up to $10,000 each, for prosecution of the Action, risks undertaken for the payment of attorneys’ fees and costs; (2) the Settlement Administration Costs to the Settlement Administrator, CPT Group, Inc., in an amount estimated not to exceed $25,000; (3) a PAGA payment of $50,000 (75% allocated to the Labor Code Private Attorney General Act of 2004 claims) to the California Labor Workforce Development Agency (“LWDA”) with the remaining twenty-five percent (25%) ($12,500) of the PAGA Payment to be distributed to Eligible Aggrieved Employees; (4) payment to Class Counsel for Class Counsel fees in an amount not to exceed $437,000 (38% of the Gross Settlement Value) for attorneys’ fees; and (5) payment to Class Counsel of Class Counsel Expenses in an amount not to exceed $25,000 for litigation costs. All of these payments are subject to court approval.
Net Settlement Value means that Net Cash Distribution plus the Expense Fund.

Related to Net Settlement Value

  • Net Settlement Amount means the Gross Settlement Amount, less the following payments in the amounts approved by the Court: Individual PAGA Payments, the LWDA PAGA Payment, Class Representative Service Payment, Class Counsel Fees Payment, Class Counsel Litigation Expenses Payment, and the Administration Expenses Payment. The remainder is to be paid to Participating Class Members as Individual Class Payments.

  • Settlement Value means the amount which the holder of a Contract may receive for a Contract held until Expiration. The Settlement Value of a Binary Contract is $100. The Settlement Value of a Variable Payout Contract is determined as described in the definitions of Long and Short Variable Payout Contracts.

  • Net Settlement Fund means the Settlement Fund less: (i) any Taxes;

  • Cash Settlement Averaging Period has the meaning set forth in Section 12.13(a).

  • Disruption Cash Settlement Price means in respect of each Security, an amount in the Settlement Currency equal to the fair market value of the Share Amount (taking into account, where the Settlement Disruption Event affected some but not all of the Shares comprising the Share Amount and such non-affected Shares have been duly delivered as provided above, the value of such Shares), less the cost to the Issuer of unwinding any underlying related hedging arrangements, all as determined by the Issuer.
