Marketplacer does not warrant that it is able to backup or recover specific Operator Data beyond its explicit commitments in this Agreement.
The Operator is responsible for securing and maintaining its own backup of the Operator Data as required for its business purposes.
The Operator is responsible for the accuracy, quality and legality of Operator Data, the means by which the Operator acquired Operator Data, Operator’s use of Operator Data with the Services, and the interoperation of any third party applications with which Operator uses the Platform or Services.
Provided that the Operator makes the request in writing within 30 days of the date of termination, Marketplacer will also provide a copy of the Operator Data in Marketplacer’s possession to the Operator following termination of this Agreement.
Marketplacer will use reasonable efforts to provide the Operator Data within a reasonable timeframe following receipt of the request.
You shall not have more than one Meter Operator, Data Collector or Data Aggregator at any one time to perform the relevant Agent Service for each Metering Point.
Operator shall ensure that Operator’s use of the Services and all Operator Data (and the collection, storage, disposal, transfer and other use thereof) is at all times compliant with Operator’s privacy policies, all Applicable Laws, the Card Organization Rules and the PCI SSC Data Security Standards, including those rules, regulations and policies related to data privacy and transfer, international communications, and the exportation of technical or personal data.
The following Sections shall survive any expiration or termination of this Agreement: 1.3 (General Restrictions), 1.4 (Processing Agreement and Operator Agreements with Processor; Compliance with Laws, Rules and Regulations; Prohibited Activities), 4.3 (Storage of Operator Data), 4.4 (Ownership), 6 (Fees and Payment), 7 (Term and Termination), 8 (Warranty Disclaimer), 10 (Limitation of Remedies and Damages), 11 (Indemnification), 12 (Confidential Information), and 13 (General Terms).
Operator is solely responsible for the accuracy, content and legality of all Operator Data.
Registry Operator shall establish at its expense a data escrow or mirror site policy for the Registry Operator Data compiled by Registry Operator.
