Partial Taking definition

Partial Taking means the taking of only a portion of the Premises which does not constitute a Total Taking; (4) "Date of Taking" means the date upon which the title to the Premises, or a portion thereof, passes to and vests in the condemnor or the effective date of any order for possession if issued prior to the date title vests in the condemnor; and (5) "Award" means the amount of any award made, consideration paid, or damages ordered as a result of a Taking.
Partial Taking means any Taking (including any damaging) of a portion of the Premises, the Common Area, or any Improvements or parking thereon which is not a Total Taking.

Examples of Partial Taking in a sentence

  • If only a portion of the Premises shall be so taken or condemned such that it does not constitute a Complete Taking (a "Partial Taking"), this Agreement shall not terminate as a result thereof, but the rent to be paid by Tenant from the date of such Partial Taking shall be equitably adjusted.

  • If a Partial Taking occurs, then the Term shall not be reduced or affected in any way, this Lease shall remain in full force and effect for the portion of the Property remaining after such Taking and the Tenant's obligation to pay Rent shall continue without abatement or diminution.
