• The Performance Guarantor shall procure that no substantial change is made to the general nature and scope of the business of the Performance Guarantor from that carried on at the date hereof which would result in a Herc ▇▇▇▇▇ ▇▇▇▇▇▇▇▇ Adverse Effect.

• Except for items specifically required to be delivered hereunder, the Administrative Agent shall not have any duty or responsibility to provide any Managing Agent with any information concerning the Borrowers, the Performance Guarantor, the Servicer or any Originator or any of their Affiliates that comes into the possession of the Administrative Agent or any of its officers, directors, employees, agents, attorneys-in-fact or Affiliates.

• Each of the Borrowers, the Servicer and the Performance Guarantor hereby agrees to perform and observe the covenants applicable to it set forth in Exhibit IV hereto.

• The Performance Guarantor will deliver to the Administrative Agent and each Lender, promptly following any request therefor, information and documentation reasonably requested by the Administrative Agent or any Lender for purposes of compliance with applicable “know your customer” requirements under the PATRIOT Act or other applicable Anti-Money Laundering Laws.
