Persistent Default definition

Persistent Default means two (2) Defaults within the Contract Period;
Persistent Default means where the Provider has committed more than six [6] Defaults during any consecutive period of twelve [12] months, whether or not these are the same Defaults or different Defaults and even if the Provider remedies the default each time;
Persistent Default means two (2) Defaults within the Contract Period; “Premises” means the location where the Services are to be supplied, as set out in the Invitation to Tender;

Examples of Persistent Default in a sentence

  • The Authority may terminate the Contract by giving written notice to the Supplier with immediate effect if the Authority commits a Persistent Default.

  • The Customer may terminate the Contract by giving written notice to the Service Provider with immediate effect if the Customer commits a Persistent Default.

  • Persistent Default Where either of us has committed more than two Defaults during any period of twelve months, whether or not these are the same Defaults or different Defaults and even if each party has rectified the Default each time.

  • The CLIENT may terminate the Contract by giving written notice to the SERVICE PROVIDER with immediate effect if the SERVICE PROVIDER commits a Persistent Default.

  • If either of us commits a Persistent Default or fails to rectify a Default within the timescale set out in any Default Notice we will each be entitled to end this Contract immediately by giving the other party notice in writing.


More Definitions of Persistent Default

Persistent Default means two (2) Defaults within the Contract Period; “Premises” means the location where the Services are to be supplied,
