The Participants and the Ministry acknowledge and agree that, in providing certain of the Services the Ministry may be acting as an Electronic Service Provider and not a PHIPA Agent.
The following provisions apply where the Ministry is acting as a HINP, Electronic Service Provider or PHIPA Agent with respect to the Services.
Upon acceptance of this Agreement by the Contributor, the Contributor appoints eHealth Ontario as its PHIPA Agent so that eHealth Ontario may perform the PHIPA Agent Permitted Purposes in Schedule “A” and, as the Contributor’s PHIPA Agent, eHealth Ontario agrees to collect, use and disclose Contributor Data only if the Contributor is permitted or required to collect, use and disclose the Contributor Data under PHIPA, unless otherwise required under Applicable Laws.
The Ministry and the Participants acknowledge and agree that in connection with its processing of Participant PHI on behalf of the Participants, including without restriction inproviding the Services the Ministry may be acting as the PHIPA Agent of the applicable Participants.
In the event the Ministry is acting as a PHIPA Agent of a Participant, the Ministry acknowledges and agrees that it will process Participant PHI only in accordance with the Designated Purposes and in accordance with the Agreement, or as it may be additionally authorized or directed by any Participants and will not acquire any custody or control of any such Participant PHI.
It is acknowledged and agreed that in acting as a PHIPA Agent, the Ministry is doing so only in the capacity in which the term PHIPA Agent is defined in the Agreement and, unless specifically authorized in writing, is not acting as an agent of the Participants in any other capacity.
In particular, and in furtherance of this purpose, Ontario may: Provide the Relevant PHI to eHealth Ontario, acting as the Ministry’s PHIPA Agent; Permit eHealth Ontario as the Ministry’s PHIPA Agent to provide the Relevant PHI to eHealth Ontario acting as a health information network provider under authority of s.
