Project Segment definition

Project Segment means a part of the Project extending the full width of the Project Right of Way, including the applicable portions of the Toll Lanes, General Purpose Lanes, Frontage Roads and cross streets and applicable transitions and connections to adjacent infrastructure, as identified in the Project Segment Plan submitted to and approved by TxDOT pursuant to Section 1.3 of the Technical Provisions.

Project Segment means the costs, described in an Official Intent of the Issuer, incurred prior to the Closing Date to acquire, construct, or improve land, buildings or equipment excluding current operating expenses but including costs of issuing the Reimbursement Bonds.

During such notice period, Developer, TxDOT and the Independent Engineer shall meet and confer and exchange information on a regular cooperative basis with the goal being TxDOT's and the Independent Engineer’s orderly, timely inspection and review of the applicable Project Segment and the applicable Final Design Documents and Construction Documents, and TxDOT’s issuance of a written certificate of Substantial Completion.
Within five days after expiration of such 15-days period and TxDOT’s receipt of the Independent Engineer’s report, TxDOT shall either (i) issue a certificate of Final Acceptance for the Project Segment or (ii) notify Developer why Final Acceptance for the Project Segment has not been achieved.
The Members shall provide reasonable assistance to the Tax Matters Member in the filing of the Cash Grant Applications, the submission of any supplemental information and other reasonable efforts by the Tax Matters Member to obtain the Cash Grant for each Project Segment and to comply with the Cash Grant reporting requirements, including the provision of any requested information about the Members and their Affiliates, if and to the extent required.
