Relevant Effect definition

Relevant Effect means that the Force Majeure has (or will, with reasonable certainty, have) the direct effect of making it unlawful or practically impossible for the Exhibitor to install or have the Exhibition installed, or from operating or "▇▇▇▇▇▇▇" the Exhibition during the Event. If Force Majeure occurs, the Exhibitor may, at any time before the commencement of the Event, notify Us that the Exhibitor wishes to cancel its Exhibition, giving particulars of the Force Majeure circumstances and the Relevant Effects (a "Force Majeure Cancellation Notice"). Upon receipt of a Force Majeure Cancellation Notice, We will consider it in good faith and if, acting reasonably, We accept the particulars given, We will refund Exhibition Fees We have received under this Agreement, less a fee of five hundred dollars ($500) including GST, to cover administration and other costs.

If Force Majeure occurs, the Sponsor may, at any time before the commencement of the Event, notify Us by email that the Sponsor wishes to cancel its Sponsorship, giving particulars of the Force Majeure and the Relevant Effects (a "Force Majeure Cancellation Notice").   • Significant Effect under clause 10.3 above includes termination of employment (including redundancy), major changes in the composition, operation or size of the Employer’s workforce or in the skills required, the elimination or diminution of job opportunities, promotion opportunities or job tenure; the alteration of hours of work; changes to safety and/or management systems, any changes to employment practices that result in privacy concerns for employees such as implementation of electronic inductions and/or access systems; the need for retraining or transfer of Employees to other work areas or locations and the restructuring of jobs.

  • Contract Effective Date ’ means the date agreed upon by the parties for be- ginning the period of performance under the contract. In no case shall the effective date precede the date on which the contracting officer or des- ignated higher approval authority signs the document. Costs incurred be- fore the contract effective date are un- allowable unless they qualify as precontract costs (see FAR 31.205–32) and the clause prescribed at 1831.205–70 is used.

  • Agreement Effective Date means the date on which the conditions set forth in Section 2 have been satisfied or waived by the appropriate Party or Parties in accordance with this Agreement.

  • Settlement Effective Date means the date on which the Final Order is Final, provided that by such date the Settlement has not been terminated in accordance with Article 11.
