SEAI may, at its discretion, initiate the Remedial Plan Process during a period of suspension.
If the Assessment Supplier does not achieve a Service Level, the SRA may initiate and require the Assessment Supplier to comply with the Remedial Plan Process.
The Parties shall not follow the Remedial Plan Process where the Provider has already failed to resolve the relevant Default in accordance with a Correction Plan pursuant to Clauses 12 (Correction Plan) or 29 (Notification and Remedial Measures).

Subject to the provisions of clauses 56.5.2, 56.5.3 and 57 (Remedial Plan Process), the Authority may, by one month's prior written notice, require the Partial Termination of any part of the Services on the occurrence in relation to that part of a material Default by the Contractor, where the Default is not capable of remedy or, if the Default is capable of remedy, the Default has not been remedied in accordance with the Remedial Plan Process.
The Remedial Plan Process is as follows: The Authority notifies the Supplier that it considers that the Supplier is in material Default and that it requires a Remedial Plan.
Without prejudice to any right of the Customer to terminate this Services Agreement pursuant to clause 54 (Termination Rights), if the Contractor commits a material Default and the Default is capable of remedy, the Customer may at its discretion operate the Remedial Plan Process.
