For clarity, the Required Availability Rate shall not apply to any Licensed Products other than the cloud-based speech recognition service component, such as software installed on Customer Systems.
Power’s other remedies under this Contract, should the Services Schedule provide that liquidated damages are payable if the Availability is less than the Required Availability Level, then such liquidated damages are payable in accordance with the terms of that Services Schedule unless the Unavailability is a direct result of periods of Scheduled Maintenance or actions taken by Western Power or AEMO.
