Proceeds recovered from all Retained Causes of Action will be deposited into a bank account maintained by the Liquidating Trust and will be distributed by the Liquidating Trustee to the Beneficiaries in accordance with the provisions of the Controlling Documents.
Within thirty (30) days after the last day of each calendar quarter in which the Liquidating Trust shall remain in existence, the Liquidating Trustee shall file a report with the Bankruptcy Court of the administration of property subject to its ownership and control pursuant to the Plan, receipts, Distributions made by it, an update regarding the status of the Retained Causes of Action being prosecuted by the Liquidating Trust, and a summary of all major activities during the period.
The Liquidating Trustee shall forever hold strictly confidential and not use for personal gain any material, non-public information of, or pertaining to, any Entity to which any of the Liquidating Trust Assets, including Retained Causes of Action, relates, or which he or she has become aware of in his or her capacity as Liquidating Trustee.
Subject to the Controlling Documents, and upon consulting with the Liquidating Trust Advisory Board, on and after the Effective Date, the Liquidating Trustee may hire legal counsel, obtain litigation funding, and pursue Retained Causes of Action.
All Retained Causes of Action that are not expressly released or waived under the Plan are reserved and preserved, transferred to and vest in the Liquidating Trust in accordance with the Controlling Documents.
