• Partner will not make any representations or warranties regarding the functionality or performance of the SAP Solution that conflict with the Agreement.

• Partner will operate SAP Solution Manager in accordance with Section A (SAP Solution Manager).

• Partner must document Custom Code according to SAP’s then-current standards in the SAP Solution Manager (for details see http//▇▇▇▇▇▇▇.▇▇▇.▇▇▇).

• Manager Enterprise Edition may not be offered by Customer as a service to third parties; provided, third parties authorized to access Cloud Services under the Agreement may have access to SAP Solution Manager Enterprise Edition solely for SAP-related support purposes in support of Customer’s internal business operations under and in accordance with the terms of the Agreement and this Attachment 1.

• The right to use any SAP Solution Manager Enterprise Edition capabilities under this Attachment 1 other than those listed above is subject to a separate written agreement with SAP, even if such capabilities are accessible through or related to SAP Solution Manager Enterprise Edition.

• SAP, SAP SE, their Affiliates, or licensors own all Intellectual Property Rights in and related to the SAP Solution, SAP Materials, Documentation, Modifications, design contributions, related knowledge or processes, and any derivative works of them conceived or created by SAP (collectively, “SAP IP”).

• Partner agrees that it is not relying on delivery of future functionality, public comments or advertising of SAP or product roadmaps in obtaining a license for any SAP Solution.

• Restrictions on the type of Customer Data that SAP allows to be submitted processed in the Integrated SAP Solution, also apply to the Cloud Service.
