During a Case of Emergency, Users are not charged with the Daily Scheduling Charges.
The Transfer User shall be exempt from the obligation to pay Daily Scheduling Charges if the quantity that is distributed to him falls short of the quantity that he has stated in his last Approved Statement at a Point of Exit as a result of the Operator’s failure to comply with his obligation regarding Minimum Pressure for Delivery at the said Point of Exit.
No failure or delay by either Party in exercising any of its rights under this Agreement will be deemed to be a waiver of that right, and no waiver by either Party of a breach of any provision of this Agreement will be deemed to be a waiver of any subsequent breach of the same or any other provision.
