If Design-Builder intends to conduct additional geotechnical evaluations to supplement or corroborate the information contained in the RFP Documents, it shall do so during the Scope Validation Period.
During the Scope Validation Period, Design-Builder shall thoroughly review and compare all of the then-existing Contract Documents, including without limitation the RFP Documents and the Proposal, to verify and validate Design-Builder’s proposed design concept and identify any defects, errors, or inconsistencies in the RFP Documents that affect Design-Builder’s ability to complete its proposed design concept within the Contract Price and/or Contract Time(s) (collectively referred to as “Scope Issues”).
By executing this Agreement, Design-Builder acknowledges that the Scope Validation Period is a reasonable time to enable Design-Builder to identify Scope Issues that will materially impact Design-Builder’s price or time to perform the Work.
The Parties acknowledge that the purpose of the Scope Validation Period is to enable Design-Builder to identify those Scope Issues that could not reasonably be identified prior to the Agreement Date.
Design-Builder shall thoroughly review and compare all such documents during the Scope Validation Period and, to the extent that any Scope Issues arise, Department shall consider such issues in accordance with Section 2.2 above.
For the avoidance of doubt: (1) Design-Builder shall not be entitled to raise in its Supporting Documentation any Scope Issues that were not previously addressed in a General Notice; and (2) Design-Builder shall have no right to seek any relief for any Scope Issues that have not been specifically identified in a General Notice provided to Department during the Scope Validation Period.
If Design-Builder intends to seek relief for a Scope Issue, it shall promptly, but in no event later than the expiration of the Scope Validation Period, simultaneously provide Department and the APDD Point of Contact in writing with a notice (“General Notice”) of the existence of such Scope Issue, which General Notice shall generally explain the basis for such Scope Issue.
Design-Builder acknowledges that the purpose of the Scope Validation Period is to enable Design-Builder to identify those Project Site and Scope Issues that could not reasonably be identified prior to the Technical Proposal Due Date.
For the avoidance of doubt: (1) Design- Builder shall not be entitled to raise in its Supporting Documentation any Scope Issues that were not previously addressed in a General Notice; and (2) Design-Builder shall have no right to seek any relief for any Scope Issues that have not been specifically identified in a General Notice provided to Department during the Scope Validation Period.
Notwithstanding the foregoing, no area of the Site shall be considered non-accessible if Design- Builder: (1) did not identify such area of the Site in its Scope Validation Plan to conduct Scope Validation, or (2) Design-Builder failed to submit required information to obtain the proper Governmental Approvals or other permits to access such area of the Site during the Scope Validation Period.
