If the Second Note Closing Date does not occur by June 15, 1997 or on the Second Note Closing Date any of the conditions specified in Sections 7.1, 7.3 or 7.4 shall not have been fulfilled, each Investor shall, at its election, be relieved of all of its obligations under this Agreement to purchase the Notes to be purchased at the Second Note Closing without thereby waiving any other rights it may have by reason of such failure or such nonfulfillment.
