The contractor agrees to submit, and shall require its subcontractors to submit to them, annual reports detailing the total number of labor hours worked on the Section 3 Project, the total number of labor hours worked by Section 3 Workers, and the total number of hours worked by Targeted Section 3 Workers, and any affirmative efforts made during the quarter to direct hiring efforts to low- and very low-income persons, particularly persons who are Section 3 workers and Targeted Section 3 workers.

A Section 3 Project, determined at the project site level, is a housing rehabilitation, housing construction and other public construction project where more than $200,000 of federal HUD funds, like the funds subject to this Agreement, are being spent.
If the funds subject to this Agreement will fund a Section 3 Project, compliance with Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u, implementing regulations set forth at 24 CFR Part 75 and HCR’s Section 3 policies (together, “Section 3”) shall be a condition of the Federal financial assistance provided under this Agreement and binding upon the Corporation, Subrecipient, and any of Subrecipient’s sub-subrecipients, contractors, and subcontractors.
The following Section 3 Clause applies to all subrecipients of HUD funding as well as all contracts and subcontracts for the construction, reconstruction, conversion or rehabilitation of housing (including reduction and abatement of lead-based paint hazards), and other public construction on projects that meet the definition of a Section 3 Project found in 24 CFR § 75.3(a)(2) and assisted with HUD funds in an amount that exceeds the funding thresholds found in that section.
The Contractors also hereby acknowledge and agree to comply with the Developer/Contractor HUD Section 3 Project Compliance Requirements as set forth in Attachment B attached hereto and incorporated herein by this reference.
When the Authority has confirmed the Estimate in accordance with paragraph 7.1 of this Section 3, Project Co shall, subject to Project Co obtaining all new or amended Necessary Consents that are required and have not already been obtained, implement the required Medium Value Change in accordance with the Estimate.
It is worth reiterating at this point, that as detailed in Section 3: Project Background, the FIU and ILVC are interventions in their own right.
