The Parties agree that the Services are not intended for the processing of Sensitive Data, and that if Customer wishes to use the Services to process Sensitive Data, it must first obtain the Processor’s explicit prior written consent and Customer is responsible for ensuring any additional conditions that apply to such processing under Applicable Data Protection Laws are fulfilled.
Therefore, notwithstanding anything else in this Agreement, Groundswell has no liability for Sensitive Data accessed, used, transmitted, displayed or stored in connection with Customer’s or any of its End Users’ use of the Products or the Services.
The collection of Sensitive Data is determined or instructed by Customer for its own purposes or to fulfill the requirements set by other Client companies Customer works with.
The Parties acknowledge and agree that, (a) the Products are not designed for the purpose(s) of storing, processing, compiling or transmitting Sensitive Data, and (b) except as otherwise provided herein, neither Customer nor any of Customer’s End Users shall use the Products or Services for, or provide to Groundswell, without prior written consent, storing, processing, compiling or transmitting Sensitive Data under this Agreement or any other Customer Agreement.
The parties understand and agree any provision of services by CBRE in relation to the Purpose does not require the use of Sensitive Data by CBRE.
