Kodak will provide Support Services for (a) the latest Software Upgrade following the date it is made generally available and (b) for the immediately prior upgrade during the twelve (12) month period following the date the latest Software Upgrade is generally available.
Vendor shall comply with the Software Upgrade Plan during the Term.
In the case of AS Software, the AS Product Warranty Period applicable to any such AS Software will be automatically extended for a new ninety (90) day period commencing on the date of the completion of any applicable Software Upgrade and/or Software Enhancement upon, and simultaneous with, any Software Upgrade and/or Software Enhancement issued pursuant to the terms of Section 12.
If a subsequent Software Upgrade requires an upgrade to the Hardware, Customer may choose to either (i) upgrade the Hardware at its cost and install the subsequent Software Upgrade or (ii) receive Support Services on their current Hardware and Software through the support life cycle of the applicable Software and Hardware.
The Vendor is authorized by the Owner to install and integrate, at the Vendor's expense, any Software Upgrade or Software Enhancement pursuant to mutual agreements reached between the Vendor and the Owner.
