In accordance with Public Contract Code §3400, the District will not consider or accept alternatives or substitutions for any Specified Items so identified.
The Contractor shall reimburse the District for all costs and expenses incurred by the District to review a proposed substitution for Specified Items.
If any Specified Items are identified in any portion of the Contract Documents as “District Standard Materials/Equipment” “match existing in use” or similar words/phrases, in accordance with Public Contract Code §3400, the District shall be deemed to have made a finding that such Specified Items are designated as “sole source” items designed to match existing and in use items.
No substitution of any specified item, product, material or system (“Specified Items”) will be considered unless the Contractor submits a request to substitute Specified Items along with data substantiating the equivalency of the proposed substitution with the Specified Items not more than ten (10) days after the date of award of the Contract to the Contractor.
