Subsurface Conditions has the meaning in Section 7.1.2.

  • Conga maintains the Service (space, power, physical security, environmentals) with leading, world- class hosting providers.

  • Subsurface Conditions: Where investigation of subsurface conditions have been made by Owner in respect to foundation or other design, Contractor may inspect Owner's records of such investigation, including examination of samples and drill cores, if any.

  • Nothing in this Section shall be deemed to limit or otherwise affect the scope of the Owner’s obligations with respect to Specified Subsurface Conditions, Regulated Site Conditions and Differing Geotechnical Conditions, as expressly set forth in Section 3.4 (Geotechnical and Regulated Site Conditions) of this Design-Build Agreement.

  • On and after the Construction Date, the Design-Builder shall not be entitled to any such relief in the event that it encounters unexpected subsurface conditions at the Project Site except for Specified Subsurface Conditions or Regulated Site Conditions, regardless of the adverse affect such discovery may have on the Design-Builder.

  • Prior to commencement of any Equipment Supply Obligations at the Project Site, Buyer shall evaluate or cause to be evaluated the Soil and Subsurface Conditions (including the presence of caverns or voids) where the Equipment Supply Obligations are to be performed and inform Supplier of any area of sensitivity identified.

  • Concealed Subsurface Conditions shall not include conditions handled or mitigated by Contractor utilizing equipment planned to perform that component of the Work within a reasonable period of time.

Related to Subsurface Conditions

  • Subsurface Borings and Testing means borings, probings and subsurface explorations, laboratory tests and inspections of samples, materials and equipment; appropriate professional interpretations of all the foregoing.

  • Review Conditions means (i) the Delinquency Percentage for any Payment Date exceeds the Delinquency Trigger for that Payment Date and (ii) the Noteholders or Note Owners, as applicable, have voted, pursuant to Section 2.03(d) of the Receivables Purchase Agreement, to direct an Asset Representations Review of the Subject Receivables.

  • Licence Conditions means the licence terms and conditions contained in this document, as amended from time to time in accordance with this agreement.

  • Soil means all unconsolidated mineral and organic material of any origin.

  • Unsafe condition as used in this clause means the actual or potential exposure of contractor or Government employees to a hazardous material as defined in Federal Standard No. 313, and any revisions thereto during the term of this contract, or any other material or working condition designated by the Contracting Officer's Technical Representative (COTR) as potentially hazardous and requiring safety controls.
