Time for Performance definition

Time for Performance means unless otherwise explicitly stated in writing, the time for which Seller shall commence performance of the Work under the Contract.
Time for Performance means, in relation to a contract of any description mentioned in subsection (1) above, the time for performance by the air travel organiser of any of his obligations under the contract with respect to the provision of any services, accommodation or facilities; and
Time for Performance means the time for completing the Works or a Section (as the case may be) under Clause 9 (with any extension under Clause 13, calculated from the Commencement Date.

  • The Time for Performance under this Agreement may only be adjusted by Change Order, in the sole and absolute discretion of City.

  • Any request for an extension of the Time for Performance must be submitted in a writing delivered to the City Project Manager, along with all supporting data, within SEVEN (7) calendar days of the occurrence of the event giving rise to the need for adjustment unless the City allows an additional period of time to ascertain more accurate data.

  • When Time for Performance is delayed due to the requirements of the Closing Disclosure Rule and such delay is not solely caused through any failure of Purchaser to timely act as per the Purchaser’s lender’s requirements for loan completion then the Closing Date (as defined below) may be delayed until the Purchaser receives a revised Closing Disclosure but in no event more than five (5) business days from the original Closing Date.

  • A-E shall diligently perform in a competent and professional manner those tasks and duties set forth in Appendix 1 - Scope of Services, attached hereto, in the time set forth in the Article titled Time for Performance below.

  • Supplier’s liability for the goods, services and software supplied by Supplier under the Contract, and available remedies for Supplier’s delay in any performance or delivery or breach of any warranty shall, to the extent permitted by applicable law, be limited to what is provided for in section 5 (Time for Performance and Delivery), section 7 (Software and Online Services) and section 8 (Warranties) and, if applicable, otherwise explicitly specified in the Contract.

  • Liquidated damages are hereby fixed and agreed upon by the parties, recognizing the impossibility of precisely ascertaining the amount of damages that will be sustained by County as a consequence of such delay, and both parties desiring to obviate any question or dispute concerning the amount of said damages and the cost and effect of the failure of Consultant to complete the respective phases within the applicable Time for Performance.

  • In the event that the Buyer does not successfully complete the Services on or before the Time for Performance, then (i) the Sellers will have no duty to transfer the Membership Interest to the Buyer, and (ii) the Buyer’s only consideration for performing the Services will be the Company’s payment of the Buyer’s invoices, as set forth in this Section 1, which shall not exceed $65,000.00 in the aggregate.

  • The Contractor agrees that the performance of Construction shall be pursued on schedule, diligently and uninterrupted at a rate of progress which will ensure full completion within the agreed Time for Performance.

  • No event described in this Section 4 (Time for Performance) shall excuse any obligation to pay any amount due to the other Party for Services performed or Materials provided prior to the failure or delay of performance.

  • The Agreement terms in the Time for Performance paragraph related to written extensions and termination shall remain as written.


More Definitions of Time for Performance

Time for Performance means the completion schedule defined in Section 5. “Unavoidable Delays” means any delay in the Project caused by: (a) economic, industry-wide strikes, (b) fire, (c) unusual delays in transportation, (d) acts of God, (e) acts of the public enemy, (f) floods, (g) rebellions, riots, insurrections or sabotage, (h) unusually adverse weather conditions, (i) arbitrary suspension, stoppage, or interruption of the Project by Owner, or (j) approved Change Orders.

Related to Time for Performance

  • Final Performance means the Final Valuation Price divided by the Initial Price(Settlement) each in respect of the Worst Performing Underlying Asset as calculated in respect of the Final Valuation Date. "Final Valuation Date" means 29 November 2027, subject to adjustment.

  • human performance means human capabilities and limitations which have an impact on the safety and efficiency of aeronautical operations;
